Welcome to Pledge. By accessing or using our mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Description of Service

Pledge is a habit-building platform that helps users create, track, and maintain positive habits through:

• AI-powered personalized daily task generation
• Habit and pledge tracking with progress monitoring
• Community pledges and shared challenges
• Motivational notifications and reminders
• Analytics and insights on your habit-building journey

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

4. Subscription and Payments

4.1 Free and Premium Features

Pledge offers both free and premium subscription tiers. Free users have access to basic features with limitations on the number of pledges they can create. Premium subscribers gain access to additional features, unlimited pledges, and advanced AI capabilities.

4.2 Billing and Renewal

Premium subscriptions are billed in advance on a monthly or annual basis. Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage your subscription through your account settings or the respective app store.

4.3 Refunds

Refunds are handled according to the policies of the platform through which you made your purchase (Apple App Store or Google Play Store). Please refer to their respective refund policies for more information.

5. User Conduct

When using our Service, you agree NOT to:

• Violate any applicable laws or regulations
• Infringe on the rights of others, including intellectual property rights
• Upload or share harmful, offensive, or inappropriate content
• Harass, bully, or harm other users
• Create pledges that promote illegal activities or harmful behavior
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated systems or bots to access the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer or attempt to extract the source code of the Service
• Use the Service for commercial purposes without our consent

6. User Content

6.1 Your Content

You retain ownership of any content you create or upload to the Service, including pledges, goals, and descriptions. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with providing the Service.

6.2 Community Pledges

If you create a public or community pledge, other users may be able to view and join your pledge. You are responsible for ensuring your public content is appropriate and does not violate these Terms.

6.3 Content Moderation

We reserve the right to review, remove, or disable access to any content that violates these Terms or that we find objectionable, without prior notice.

7. AI-Generated Content

Our Service uses artificial intelligence to generate personalized daily tasks and recommendations. While we strive to provide helpful and accurate suggestions, AI-generated content is provided "as is" and should not be considered professional advice (medical, financial, legal, or otherwise). You are responsible for evaluating and deciding whether to follow any AI-generated recommendations.

8. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by Pledge and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

9. Third-Party Services

Our Service may contain links to or integrations with third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites or services. Your use of third-party services is at your own risk.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

12. Indemnification

You agree to defend, indemnify, and hold harmless Pledge and its officers, directors, employees, contractors, agents, licensors, and suppliers from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through the app settings.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service will be resolved in the courts located in the United States.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
